1. About these terms

The website everfete.store (the "Store") is operated by Everfête ("we", "us", "our"). These Terms of Service apply to your use of the Store and to every purchase you make from it. By using the Store or placing an order you agree to these terms, together with our Privacy policy, Shipping policy and Refund policy.

2. Eligibility

You must be at least the age of majority where you live, or be using the Store with the permission of a parent or guardian, to place an order.

3. Products and descriptions

We try to describe and display our products accurately. Product photos are illustrative, and colours, details and packaging may vary slightly. Measurements are approximate. Some products, such as advent calendars and "Surprise Me" options, contain items chosen at random.

4. Product safety

Our plush and squishy products are recommended for ages 15 and over. They contain small parts and are not suitable for children under 3 years. Products containing magnets are not toys and must be kept away from young children and pets. Please read the safety information on each product page.

5. Prices and payment

Prices are shown in US dollars and may change at any time before you place your order. Shipping charges are shown at checkout. Payments are processed securely by our payment providers; we do not store your full card details. If a product is listed at an obviously incorrect price because of an error, we may cancel the order and refund you in full.

6. Orders

Your order is an offer to buy. A contract is formed when we confirm your order by email. We may refuse or cancel an order, for example if an item is unavailable, a pricing error has occurred or we suspect fraud; if we do, we will refund any amount you have paid.

7. Shipping, returns and refunds

Delivery, cancellations, refunds and replacements are governed by our Shipping policy and Refund policy. Risk in the products passes to you on delivery.

8. Intellectual property

All content on the Store, including text, graphics, character names, logos and images, belongs to us or our licensors and may not be copied or used without our written permission.

9. Acceptable use

You agree not to misuse the Store, including by attempting to gain unauthorised access, interfering with its operation, or using it for any unlawful purpose.

10. Third-party services

The Store is hosted by Shopify and uses third-party payment and delivery providers. Their services are subject to their own terms. We are not responsible for third-party websites linked from the Store.

11. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising from your use of the Store or a purchase is limited to the amount you paid for the product concerned, and we are not liable for indirect or consequential loss. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, or any statutory rights you have as a consumer.

12. Changes to these terms

We may update these terms from time to time. The version in force when you place your order applies to that order.

13. Governing law

These terms are governed by the laws of Malaysia. This does not deprive you of the protection of mandatory consumer laws of the place where you live, and you may bring proceedings in your local courts where those laws allow.
